Direct answer: New Zealand’s Online Casino Gambling Act 2026 is now in force, but the licensed market is still being introduced. Providers that were already serving New Zealand customers before 1 May 2026 may continue only under transitional conditions, and online casino advertising is currently prohibited. From 1 December 2026, only operators permitted to continue through the licensing process may remain in the market. Licences are expected to start being issued from early 2027.

Current Legal Status in 2026
New Zealand’s Online Casino Gambling Act 2026 is now in force, but the new licensing system is being introduced in stages and is not expected to be fully operational until 2027. Until licences are issued, an overseas licence must not be described as a New Zealand online casino licence.
The Act creates a domestic licensing and compliance framework administered by the Department of Internal Affairs. Its commencement does not mean that every overseas casino currently reachable from New Zealand has local approval. The status of a provider depends on the transitional provisions, the licensing process and, once licences are issued, the official New Zealand register.
What Changed on 1 May 2026?
The Act came into force on 1 May 2026. From that date, no new online casino provider may enter the New Zealand market during the transition. Providers that supplied online casino gambling to people in New Zealand before 1 May 2026 may continue temporarily, subject to the Act’s transitional conditions.
This temporary ability to continue operating is not a New Zealand licence. It should not be used to describe an operator as locally licensed, fully regulated in New Zealand or approved for promotional placement.
Advertising and Affiliate Marketing During the Transition
Online casino gambling advertising is currently prohibited in New Zealand. The Department of Internal Affairs states that the prohibition can apply to anyone who publishes or arranges to publish an unlawful advertisement, including third-party publishers, content creators and platforms.
For that reason, Spy Casino should not publish affiliate links, paid endorsements, bonus promotions, operator rankings or calls to register on this page during the current transition. Technical access to an offshore website does not make promotional content permissible and does not prove that the operator is authorised for the New Zealand market.
What Changes on 1 December 2026?
The Department of Internal Affairs states that online casinos which provided services before 1 May 2026 may continue only until 1 December 2026 under the initial transition. Up to 15 providers are expected to gain the right through the auction process to apply for a licence.
From 1 December 2026, providers that have not applied for a licence must stop supplying online casino gambling in New Zealand. Providers with an application under consideration may continue under an exemption while the application is assessed, but they must continue without advertising.
When Will New Zealand Casino Licences Be Issued?
The Department anticipates that licences will start to be issued from early 2027. The fully licensed regime is expected to become operational during 2027, after the expression-of-interest, auction and application stages have been completed.
The page must be reviewed before 1 December 2026 and again when the first licences and public register are published. Any operator-specific statement made after launch must match the exact brand, legal entity, domain and licence entry.
Why an Overseas Licence Is Not New Zealand Authorisation
A licence issued by an overseas regulator may describe an operator’s status under that regulator’s rules. It does not become a New Zealand online casino licence and must not be presented as evidence that the operator has passed New Zealand’s licensing assessment.
Currency display, a New Zealand-facing landing page, access from a New Zealand IP address or the presence of NZD in a cashier are also not proof of New Zealand authorisation. Once the domestic register is available, local licensing claims should be checked against that register.
How Players Will Identify Licensed Operators
The Department plans to publish a public register of licensed online casinos. Licensed operators will also be required to display a New Zealand registration icon. These official indicators should be used together: the exact operator, brand and platform should match the register rather than relying on a logo copied onto a website.
Before the register is available, no operator should be described as holding a New Zealand online casino licence. After launch, the licence status and verification date should be recorded whenever an operator is discussed.
NZD Accounts, Payments and Verification
A dollar symbol does not confirm that an account is held in New Zealand dollars. A balance may be maintained in another currency while the site displays an NZD estimate. Currency conversion can affect deposits, withdrawals and the final amount received.
Payment methods also vary by provider and account. Deposit support does not guarantee that the same method can be used for withdrawal. Identity checks may include photo identification, proof of address, payment-method ownership and, for some transactions, source-of-funds information. These points describe practical account checks and do not establish that a provider is authorised in New Zealand.
Player Protection and Complaints Under the New Regime
The new regime introduces requirements covering harm prevention, consumer protection, age and identity verification, record-keeping, advertising and complaints. Those requirements apply to operators that receive a New Zealand licence; they should not be attributed automatically to every offshore provider operating during the transition.
Once the licensed system is operating, customers will be able to complain to the operator and, where the regulatory process applies, to the Department of Internal Affairs. A person using an unlicensed platform may not receive the same New Zealand player protections.
Online Casino Gambling and Sports Betting Are Separate
The Online Casino Gambling Act does not regulate racing and sports betting. The Department states that online racing and sports betting are governed separately, and overseas online casino companies must not use their casino activity as a basis for offering racing or sports betting in New Zealand.
