Are Online Casinos Legal in Australia?

The Interactive Gambling Act 2001 sets the federal rules for gambling services offered online, through apps and by telephone. Under ACMA guidance, providers must not offer prohibited interactive gambling services to people in Australia. Online casinos are specifically listed among the banned services.

The distinction between the provider and the customer matters. The federal prohibition described by ACMA focuses on supplying and advertising the service. However, a player’s ability to open a website does not make the service authorised, and using an illegal offshore operator can leave the player without the protections available through an Australian-licensed wagering provider.

Which Online Gambling Services Are Prohibited?

ACMA identifies several categories that cannot be offered to people in Australia. These include online casino games, online pokies, online poker, in-play sports betting, unlicensed sports betting services and betting on the outcome of a lottery.

The prohibition also applies to advertising banned services in Australia. An operator or promoter cannot avoid the rules merely by being based overseas. ACMA may investigate providers, advertisers and other parties that help promote or facilitate prohibited services.

Not every form of online gambling has the same status. That is why “online gambling” should not be used as a single legal category without explaining the product involved. Casino games, wagering, lotteries and in-play betting are treated differently under the federal framework.

Online Casinos vs Licensed Wagering Services

Online casino games and licensed wagering services are not interchangeable. Online casinos offer games such as pokies, roulette, blackjack, baccarat and casino poker. ACMA classifies these as prohibited services when supplied online to people in Australia.

Licensed online and telephone wagering services generally relate to permitted betting products and must appear on ACMA’s register of licensed interactive wagering providers. Registration on that list is relevant to wagering only; it is not evidence that the provider may offer online casino games.

A brand may operate more than one product or domain. The exact legal entity, domain, product and licensing authority therefore need to match the service being checked. A wagering licence must not be presented as casino authorisation.

How ACMA Blocks Illegal Gambling Websites

ACMA investigates complaints and can take enforcement action against prohibited online gambling services and their promotion. Available measures include formal notices, infringement notices, enforceable undertakings, remedial directions, referrals to law-enforcement bodies and requests for Australian internet service providers to block websites.

Website blocking has been used against both gambling operators and affiliate marketing services that publicise prohibited sites and link Australian users to them. A blocked domain may later reappear under another address, but that does not change the underlying regulatory status.

This guide does not provide VPN instructions, mirror-site addresses or other methods for avoiding a block. A user who encounters a suspected prohibited service can submit an interactive gambling complaint to ACMA.

Why an Offshore Licence Is Not an Australian Licence

An offshore operator may display a licence issued by another country or territory. That licence may describe the operator’s status under the issuing jurisdiction, but it does not authorise online casino games in Australia.

There is no Australian online casino licence that an offshore casino can obtain and then use as evidence that its casino games are locally approved. Australian authorisation for online wagering is checked through the ACMA register and applies to the specific licensed wagering provider, domain and product.

Terms such as “Australian licensed casino”, “licensed for Australian players” or “safe Australian casino” should not be used unless the exact claim is supported by the applicable Australian regulator. AUD display, Australian-themed branding and access from an Australian IP address are not proof of authorisation.

Risks of Using an Offshore Casino

ACMA warns that illegal offshore gambling services may not provide the customer protections attached to Australian-licensed wagering services. If an operator withholds a balance, closes the website, changes domains or continues taking money without permission, Australian regulators may have limited ability to recover the funds.

Website blocking creates an additional practical risk. A player may lose access to an account after depositing, even when the site was reachable at the time of registration. A foreign licence or complaints process may offer a route in some cases, but the outcome depends on the regulator, the legal entity and the operator’s compliance.

Anyone who has difficulty recovering money from an overseas site may consider independent legal advice, the relevant foreign licensing authority or the Australian Competition and Consumer Commission. Suspected prohibited gambling services can also be reported to ACMA.

Credit Cards and Digital Currency: What the 2024 Ban Covers

From 11 June 2024, Australian online and telephone wagering operators have been prohibited from accepting credit cards, funds linked to credit cards and digital currency such as cryptocurrency for bettingaccount deposits. The rule applies to online and telephone wagering services, including on-course bookmakers that offer those services.

The credit ban should not be described as a new casino payment rule. Real-money online casino services were already prohibited as a service category. The 2024 change concerns payment methods accepted by licensed wagering operators; it does not create or regulate an Australian online casino market.

The availability of a card, digital wallet or cryptocurrency option on an offshore casino therefore says nothing about whether the service is authorised in Australia. Payment support and regulatory status are separate questions.

Legal Gambling Options in Australia

For online use, consumers can check ACMA’s register of licensed interactive wagering providers. The register identifies the trading name, licence holder, website and Australian licensing authority for wagering services that are permitted to operate.

A service appearing on that register should still be used only for the wagering products covered by its licence. The register is not a list of online casinos, and it does not convert casino games offered by the same brand or an associated domain into authorised products.

Other gambling products can be subject to separate federal, state or territory rules. Users should check the regulator responsible for the exact product and location rather than relying on a broad claim that a site is “legal in Australia”.

BetStop and Responsible Gambling Support
