What Happens to Your Money If an Online Casino Closes?

A casino that stops trading overnight leaves players holding a balance, maybe an unpaid cash-out, and no one to ask. Whether any of it returns hinges on three points: the operator's legal standing, how customer money was stored, and what kind of closure took place. A site that simply goes offline is not the same as a business that cannot pay its debts. This guide separates those cases using regulator sources and sits next to our wider notes on responsible gambling.

What Happens When an Online Casino Shuts Down?

A planned closure is the operator's own decision. In Malta, a licensee that gives up its licence has to say in its termination letter what happens to money still owed to players. A suspension halts the right to offer games, and a revoked licence ends it for good. Insolvency belongs to another category altogether: it is about whether the company can meet its debts, which falls under company and insolvency law, not gambling licensing. Any of these can leave players out of pocket or fully repaid. The result depends on how the money was held and which rules govern it.

Are Online Casino Deposits and Winnings Protected?

Not in the way a bank balance is. According to the UK regulator, cash sitting with a betting or casino firm does not enjoy the state backing that a current account has. Licensed online brands must hold customer money apart from their own, but the regulator is explicit that this promises no repayment.

Different items sit in different positions, and the table shows how the regulator's definition of customer money treats each one.

Item Treated as customer money? Comment
Deposits Yes Cover depends on the grade the operator chose
Winnings you are owed Yes Same grade applies; payout speed is a separate matter
Bonuses already earned Yes Depends on the offer terms
Stakes on unsettled bets No Outside the definition

A deposit or a win is money the operator owes you, whereas a stake on an open bet is already tied to an outcome that has not happened. Bonus credit you are not yet entitled to is absent from the definition, so offer terms matter. How fast winnings may leave an account is a separate topic, covered in our guide to withdrawal limits.

How Different Gambling Regulators Protect Player Funds

Three regulators approach the problem differently, and the table summarises what their published rules say.

Jurisdiction Player Funds Protection What Happens If the Operator Fails
Great Britain Operators grade themselves as not protected, medium or high and must publish the grade. Remote operators need separate accounts as a minimum. Not protected: the money is part of the company's assets. Medium: insurance or Quistclose-style structures aim to pass money back to customers. High: an independent trust. None promises repayment.
Malta Player money is a distinct asset that the player owns, and the account balance must be at least what players are owed. The licensee's creditors cannot claim player money, and insolvency law does not touch it. The regulator can direct where the money goes, and any deficit comes from the licensee's own resources. The Act, Regulations and Directive reviewed set up no compensation fund.
Denmark Player balances are entrusted funds, held in a separate account that only the licensee controls and secured against the licensee's insolvency. The account must always cover all player balances. The funds may not be used to meet claims against the licensee. Whether players can claim their balances ahead of other creditors is before the Supreme Court in the DK Gambling case.

The Gambling Commission guide sets out three grades for Britain, and each operator assigns its own:

  • Not protected. The minimum for remote operators is a separate account, but in an insolvency the money would still be counted as part of the company's estate
  • Medium protection. Insurance or a Quistclose-style structure is used so that money can be returned to customers, though success is not certain
  • High protection. The money sits in a formal trust that the company cannot reach in practice or in law, overseen by someone independent

Malta leans on legal separation. Under the Gaming Player Protection Regulations, player money is a distinct asset that the player owns, and in an insolvency the administrator must hand control of it to whoever the Authority names, on demand. If a licensee mixed player money with its own, players' claims would rank ahead of all others. The Player Protection Directive adds that the balance must cover every amount owed and that the licensee must be able to withdraw the money from the account at any time. A separate account is a safeguard, not a promise.

Denmark shows why. Section 11 of the online casino order says player balances are entrusted funds that must be secured in case the licensee becomes insolvent. Yet after DK Gambling ApS went bankrupt in April 2022, the trustee rejected players' claims to be paid out ahead of other creditors. The Maritime and Commercial Court sided with the trustee in March 2024, and the Gambling Authority backed the player. The Eastern High Court ruled on 13 November 2025, and the Supreme Court must now decide whether a player's balance counts as a separate claim in the estate. Until it does, even a written rule is not proof of repayment.

Can You Recover Money From a Bankrupt Casino?

Occasionally, though no source promises it and nobody can give a timescale. What comes back depends on the grade of protection, what assets remain, and who else has a claim ahead of you. Four steps are realistic:

  1. Begin with the operator's own statement
  2. Establish whether an administrator or liquidator has taken over, as that person normally deals with claims
  3. Find out how creditors lodge a claim and whether there is a cut-off date
  4. Ask how your balance and any payment in progress are categorised: held separately for customers, or an ordinary debt

Money under a not protected grade sits among the company's assets and ranks alongside other creditors. In Malta, players who are owed money can bring collective proceedings under the Gaming Act. Be wary of anyone promising a guaranteed refund, especially third parties who ask for a fee or your login details.

What Should Players Do If Their Casino Closes?

Work through these steps in order while records are still available:

  1. Screenshot your balance, account details and complete transaction history
  2. Look up the licence on the regulator's public register
  3. Search for an official closure notice from the operator or the regulator
  4. Write to the operator, or to the administrator if one has been appointed
  5. Follow whichever complaint or claim route applies, for instance the Maltese regulator's player support unit or an approved ADR body

It is also worth asking your card issuer or payment provider about disputing the payment. Success is far from certain and varies with the payment method and the provider's rules. Avoid depositing again while the position is unclear.

Can a Casino Close Without Paying Withdrawals?

A late or refused payout does not prove a casino is closing. From a player's seat, three situations can look identical:

  • Routine checks. Identity or source of funds reviews pause a payout until they finish
  • Contested holds. The operator keeps winnings back and points to its terms; players can challenge this through the complaints route
  • Insolvency. The company cannot pay, which may come with public notices or action by the regulator

If your cash-out is simply slow, start with our guide to why withdrawals get delayed. Malta's Directive sets an expectation of payment within five working days of a request, where practicable.

How to Check Whether Your Casino Protects Customer Funds

Check four things before you deposit. First, the licence and regulator named on the site, confirmed on the regulator's own register. A logo or badge alone proves nothing. Second, the terms: British licensees must disclose their grade and explain what insolvency would mean for your money, including at the moment of deposit. Third, the withdrawal rules on limits and timing. Fourth, the regulator's news and warnings pages. Treat the word "protected" with suspicion when the terms never name the type of account; the Commission lists that misuse, where funds are only segregated, among common errors. Save a copy of the terms when you register, as wording can change.

Conclusion

Closure does not automatically wipe out a player's balance, and it offers no guarantee of recovery either. The closure type, the licence and the way money was held decide the outcome. British operators publish a protection grade that signals the intended safeguard, while Malta relies on keeping player money separate and out of creditors' reach. Look at both before depositing, take out balances you do not need and keep records.

FAQ

Do casinos have to return money when they close?

It depends on the jurisdiction. Maltese rules put player money beyond the reach of a licensee's creditors, even in insolvency, and require the licensee to cover any shortfall. In Britain, repayment depends on the operator's grade, and no grade guarantees it.

Are online casino deposits insured?

Not in the way bank deposits are. The UK regulator says gambling balances lack that cover. Some operators add insurance or a trust, and their terms must say which grade applies.

What happens to unpaid winnings?

Winnings you are owed count as customer money in the regulator's definition, so they follow the operator's grade. Under a not protected grade they can be lost in an insolvency. Open bets fall outside.

Can I get a refund if a casino goes bankrupt?

Possibly, but nothing is certain. The outcome depends on the grade, the assets left and your place among creditors. Contact any administrator, keep records and do not expect a fixed date.

Does a gambling licence guarantee my money is safe?

No. A licence shows the operator met regulatory conditions, yet the UK regulator says even separate accounts do not guarantee repayment. Read the grade and the terms.
